1. Nature of This Service

The Permanent Library is an open-source software tool that provides two functions:

A. Uploader: A client-side web interface that encodes documents into blockchain-compatible calldata and facilitates their submission as transactions from the user's own cryptocurrency wallet to a provably unowned burn address (0x734F6C30fcd31819c46E49B98C69D89978446fa6) on supported public blockchains (Ethereum, Polygon, and Arbitrum).

B. Indexer and Search Portal: A read-only service that scans publicly available blockchain data for transactions matching the PERMLIB-V1 encoding specification, and presents them in a searchable format.

The Permanent Library does not store, host, or transmit user-uploaded content. All documents are written directly to public blockchains by the user's own wallet. The Permanent Library's servers never receive, process, or relay document content at any point during the upload process. The indexer only reads data that is already publicly and permanently available on the blockchain.

2. The Permanent Library Is a Tool, Not a Publisher

The Permanent Library is a software tool, not a content platform, publisher, or hosting service. It functions analogously to a blockchain explorer (such as Etherscan) — it reads and displays data that already exists on public blockchains.

The operators of The Permanent Library:

3. User Responsibility

By using The Permanent Library, you acknowledge and agree that:

4. No Content Moderation or Takedown Capability

Due to the fundamental architecture of blockchain technology, The Permanent Library cannot comply with content removal requests for data that has been written to the blockchain. This is not a policy choice — it is a technical impossibility inherent to all public, permissionless blockchains.

The indexer and search portal operated by The Permanent Library may, at the operators' sole discretion, exclude specific documents from being displayed in search results. However, any such exclusion from the indexer does not affect the underlying blockchain data, which remains publicly accessible through any blockchain explorer, node, or compatible reader application.

If you believe that content indexed by The Permanent Library violates your rights, you may contact [email protected] with a detailed description of your concern. The operators will review all communications in good faith, but make no guarantees regarding action taken, as the underlying data exists beyond the control of any single party.

5. Intellectual Property and Copyright

The Permanent Library does not claim any ownership over content uploaded by users. All content remains the intellectual property of its respective owners.

The Permanent Library software itself is released as open source under the MIT License. The source code is publicly available for inspection, audit, and use by anyone.

Users who upload content represent and warrant that they either own the content or have the legal right to distribute it. The Permanent Library is not responsible for verifying ownership or licensing of user-uploaded content.

6. Disclaimer of Warranties

THE PERMANENT LIBRARY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE OPERATORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

The operators do not warrant that the encoding specification (PERMLIB-V1) will be compatible with future blockchain protocol changes or that documents encoded today will remain decodable indefinitely, although the specification is designed for maximum longevity.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATORS OF THE PERMANENT LIBRARY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

8. Assumption of Risk

You acknowledge that the use of blockchain technology, cryptocurrency wallets, and decentralized systems involves inherent risks, including but not limited to:

9. Indemnification

You agree to indemnify, defend, and hold harmless the operators of The Permanent Library from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your uploaded content, or your violation of these Terms.

10. No Financial Service

The Permanent Library is not a financial service, investment platform, or money transmitter. No financial advice is provided. The burn address is provably unowned — funds sent to it are permanently destroyed. The Permanent Library does not hold, manage, or have access to any user funds at any time.

11. Service Availability

The operators may modify, suspend, or discontinue the website, indexer, or search portal at any time without notice. The open-source nature of the software and the standalone reader application ensure that documents remain accessible even if the website ceases to operate. The blockchain data exists independently of The Permanent Library's infrastructure.

12. Privacy

The Permanent Library does not collect personal information, does not use cookies for tracking purposes, does not require user accounts or registration, and does not store any user data on its servers. The indexer reads only publicly available blockchain data.

Your blockchain wallet address and transaction history are inherently public on the blockchain and are not within The Permanent Library's control.

13. Open Source

The Permanent Library is an open-source public good. The complete source code is publicly available for review, audit, forking, and self-hosting. Anyone may operate their own instance of the indexer to independently verify and access on-chain documents.

14. Governing Law

These terms shall be interpreted in accordance with applicable international law. Given the decentralized and pseudonymous nature of this project, the operators do not submit to the exclusive jurisdiction of any particular court or legal system. Disputes arising under these terms should be resolved through good-faith communication to [email protected].

15. Modifications

These Terms of Service may be updated from time to time. Changes will be posted on this page with an updated revision date. Your continued use of The Permanent Library after any modifications constitutes acceptance of the revised terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
